These Terms of Service and User Agreement (“Terms”) govern your access to and use of Thinking in CARDS, OOUX.cards, and any related web-based tools, learning materials, documentation, and features that link to these Terms (collectively, the “Service”).

The Service is operated by [legal name of operator], located at [business address and country] (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1Who may use the Service

You may use the Service only if you can legally agree to these Terms under the laws that apply to you. If you are under the age of legal majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian.

2The Service

Thinking in CARDS provides educational material and tools for exploring Object-Oriented UX (OOUX), product concepts, objects, relationships, actions, and representations.

We may add, change, suspend, or discontinue features. We will make reasonable efforts to keep the Service available, but we do not promise uninterrupted or error-free access. Some features may depend on your browser, device, or third-party services.

The informational website does not create an account or ask you to submit login credentials. If account-based features become available through a separate application, their access and any additional terms will be presented there.

3Your projects and local storage

Some project features store your work in your browser or on your device. For those local-first features, project content is not synchronized with us or sent to our servers by design.

This means that your project data may be unavailable if you change devices or browsers, clear browser data, use private browsing, lose access to your device, or encounter a browser or storage failure. Updates to the Service or your browser may also affect locally stored data.

You are responsible for keeping your own backups of important work. Do not use local browser storage as your only copy of important project data. The local-first design does not necessarily apply to information processed by third-party hosting or services; see our Privacy Policy for details.

4Your content

You retain ownership of the content and project material you create or enter into the Service (“User Content”). These Terms do not transfer ownership of your User Content to us.

For features that run locally on your device, we do not receive your project content by design. If you choose to send us content—for example, by contacting support or submitting feedback—you give us permission to use it only to respond to you, maintain the Service, or address the matter you raised.

Do not submit content you do not have the right to use.

5Acceptable use

You agree not to:

  • Use the Service in violation of applicable law or another person’s rights.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
  • Upload or distribute malware, harmful code, or content intended to compromise systems.
  • Misrepresent your identity or use the Service to harass, defraud, or harm others.
  • Copy, modify, or redistribute the Service except as permitted by law or by our written permission.

We may restrict access when reasonably necessary to protect users, the Service, or our rights, or to comply with law.

6Our intellectual property

The Service, including its software, design, text, illustrations, and other materials, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable right to access and use the Service for its intended purpose, subject to these Terms.

“OOUX,” “OOUX.cards,” “Thinking in CARDS,” and related names or marks may belong to their respective owners. Third-party names and marks remain the property of their owners. Their appearance in the Service does not imply endorsement or affiliation unless expressly stated.

7Educational information and disclaimer

The Service provides educational information and product-modeling tools. It is not legal, financial, security, accessibility, or professional product-design advice. You are responsible for evaluating the information and decisions you make using the Service.

The Service and its content are provided “as is” and “as available.” To the fullest extent permitted by applicable law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet every requirement, preserve every project, or produce a particular result.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

8Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from your use of or inability to use the Service.

To the fullest extent permitted by applicable law, our total liability for claims relating to the Service will not exceed the amount you paid us to use the Service during the twelve months before the event giving rise to the claim. If you paid nothing, this does not create a fee or payment obligation.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or intentional misconduct where such limitation is prohibited.

9Third-party services and links

The Service may link to or rely on third-party websites, platforms, or tools. Those services are governed by their own terms and privacy practices. We are not responsible for third-party services that we do not control.

10Suspension and termination

You may stop using the Service at any time. We may suspend or discontinue all or part of the Service where reasonably necessary to maintain security, comply with law, address misuse, or operate the Service.

Because some project data is stored locally, stopping access to the Service does not necessarily delete data already stored in your browser or device. You remain responsible for exporting or backing up your work before removing browser data or changing devices.

11Changes to these Terms

We may update these Terms as the Service changes or as required by law. We will update the effective date above and, where a change materially affects users, provide notice through the Service where reasonably practical. Your use of the Service after updated Terms take effect means you accept them, to the extent permitted by applicable law.

12Governing law and disputes

These Terms are governed by the laws of [country and, if applicable, state or province], without regard to conflict-of-law rules. The courts of [city and country] will have jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim elsewhere.

13General terms

If any part of these Terms is found unenforceable, the remaining parts will continue to apply. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with any policies expressly linked to them, form the agreement between you and us concerning the Service.
